Baldwin has said that he did not pull the trigger and has told investigators that the assistant director informed him the weapon was a “cold gun,” which suggests that it was not loaded with live ammunition.

Sheriff Adan Mendoza of Santa Fe County oversaw the first investigation into Hutchins’ death and noted “a degree of carelessness” on the set of the movie.

However, he deferred to prosecutors’ judgment over possible criminal charges after delivering the findings of a yearlong investigation in October. The report makes no mention of how the ammunition wound up on the site.

In connection with the fatal shooting of cinematographer Halyna Hutchins, the armorer who was in charge of all the weapons used on the set of the Western movie “Rust,” as well as actor Alec Baldwin, will be charged with two counts of involuntary manslaughter.

The accusations will be officially filed in New Mexico’s First Judicial District Court before the end of January. Each accused individual will be required to make their first court appearance.
