The focus of Scott Peterson’s request for a new trial is Richelle Nice. Nice was one of the jurors that voted to execute Scott for killing his wife and unborn child. According to Peterson’s attorneys, Richelle lied to get on the jury and was biased against the defendant.

Cliff Gardner, the attorney for Peterson, noted that Richelle’s responses to the jury inquiry were obstructive and inconsistent. Gardner additionally revealed to the court that Richelle refused to speak with the prosecution or the defense in 2015, implying that she had something to hide. She didn’t agree to testify until she was given amnesty in 2022.
Gardner stated that the witness “refused to testify unless she was granted immunity from prosecution.”This is as far from a collaborating witness as you can go, in my opinion. Gardner further stated that Richelle’s bias against Scott was evidenced by her use of the term “small man” in their contact following the trial.
He stated:

Each of them has a different theme, although his “Little Man” is one of those focuses in every letter.
While admitting that Nice made errors when completing the jury questionnaire, prosecutor David Harris contended that these mistakes did not prove she was telling the truth. Harris clarified: She gives contradictory answers. But being incorrect need not imply being false or labeling the speaker as a liar. She may simply be terrible at filling out forms.
According to experts, the judge is unlikely to reverse the conviction due to Richelle Nice’s actions. According to a lawyer and former homicide detective Ted Williams, “I feel that even if you had a jury who did not properly answer on the questionnaire, that in and of itself is not enough to get a sentence overturned.”
