The Boston IVF Dr. Merle Berger case has caught the attention of netizens. Dr. Merle Berger, a pioneer of in vitro fertilization in Boston, is accused of secretly implanting a patient with his sperm.
Author of “Conception: A Fertility Doctor’s Memoir,” published in 2020, Berger is a former professor at Harvard Medical School who divides his time between Boston and Martha’s Vineyard.
That year, Boston IVF said in a blog post that has since been preserved that Berger’s career is “essentially the history of IVF in America.”
The allegations in Depoian’s lawsuit date back to a time before Boston IVF, a network of infertility clinics that was founded in 1986 and has several locations across Maine, New Hampshire, Rhode Island, New York, and Indiana.

Dr. Merle Berger’s Boston IVF lawsuit
Internet users have been interested in the Dr. Merle Berger case. A well-known reproductive physician in the Boston area is being sued federally by a former patient.
They allege that he secretly impregnated her with his sperm decades ago via an artificial insemination procedure.
Maine resident Sarah Depoian said in a complaint filed on Wednesday with a federal court in Boston that she and her husband had gone to Boston IVF’s now-retired co-founder, Dr. Merle Berger, for help becoming pregnant in 1980.
According to Berger’s complaint, she was “promised to perform an insemination using the sperm of a medical resident who resembled husband, who did not know her, and whom she did not know.”
During a news conference on Wednesday, Depoian’s lawyer instead claimed that the doctor had secretly changed the sperm with his own.
According to Peiffer Wolf’s partner Adam Wolf, “He did so against her wishes and without her consent.”
Some people refer to this horrific behavior as “medical rape.” Whatever name you give it, Dr. Berger’s gross and willful misconduct is unacceptable, against the law, and unethical.
Doctor Accused of Concealing Her Pregnancy
The daughter of Depoian, Carolyn Bester, was born in January 1981.
Bester informed reporters that she ordered DNA testing kits from 23andMe and Ancestry.com early this year and that’s when she found out who her real father is.
She listed her matches as including Berger’s second cousin and granddaughter.
“I started piecing it all together after I spoke with one of them,” Bester said. To say I was surprised to learn this would be a huge understatement.
It seems as if reality has shifted. There is no factual or legal basis for the accusations, which have been modified many times in the six months since the plaintiff’s lawyer first got in touch with Dr. Berger.
In a statement, Berger’s lawyer Ian Pinta of Todd & Weld refuted the claims made in the case, saying, “He will be disproven in court.”
Wolf countered that Berger did not deny the charges during the first interrogation.
He said that Depoian’s narrative has been trustworthy from the start and that they are willing to back up their assertions.
This problem first surfaced over forty years ago, prior to the founding of our firm and Dr. Berger’s employment at Boston IVF.
According to a corporate official, the knowledge of infertility and reproductive endocrinology has improved significantly over the last several decades, and the safety procedures and controls in place today would almost prevent such charges.
“Patients should be aware that our field continues to uphold the highest ethical and medical standards.”
Depoian is asking for a range of monetary damages in addition to having Berger appear in court for a jury trial.
