The United States has issued its first passport with an “X” gender designation, marking a milestone in the acknowledgment of the rights of persons who do not identify as male or female, and the State Department expects to be ready to give the choice more generally next year.

The agency would not identify the passport holder, but Dana Zzyym, an intersex activist from Fort Collins, Colorado, told The Associated Press by phone that they had received it. Since 2015, Zzyym, who prefers a gender-neutral pronoun, has been involved in a court struggle with the State Department in order to get a passport that did not force Zzyym to lie about her gender by selecting either male or female.

Zzyym (pronounced Zimm) picked up the UPS package with the passport after receiving a text and phone call from their lawyer, Paul Castillo of Lambda Legal, in the early morning. Zzyym had remained up late with two visiting campaigners to commemorate Intersex Awareness Day.

While Zzyym, 63, said it was exciting to finally acquire the passport, the purpose was to help the next generation of intersex persons gain recognition as complete citizens with rights, not to travel the world.

“I’m not a bother. I am a living being. “That’s the point,” said Zzyym, who has a tattoo on his bicep that says, “Never give up,” as a reminder of his life ambitions.

Zzyym is the first veteran to apply for a non-binary gender passport in the United States. In view of the State Department’s continued unwillingness to acknowledge an appropriate gender marker, a federal court approved Lambda Legal’s move to reopen the case on June 27, 2017.

On September 19, 2018, the United States District Court for the District of Colorado enjoined the US Department of State from withholding the sought passport based on its binary-only gender marker policy.
