Prior to being shot and killed by Philadelphia police officer Mark Dial on August 14, 2023, Eddie Irizarry had no criminal history.
Dial killed him while he was still inside his vehicle during a traffic check with six rounds, some of which went through the rolled-up driver’s side window.
Irizarry allegedly rushed out of his car, brandished a knife, and lunged at the cops after a short automobile pursuit.
“It was very evident from body camera footage that what was first reported was not actually what happened.”
With his revolver pulled, Dial can be seen getting out of his automobile and approaching Irizarry’s car on the body cam footage. “I will f— shoot you,” he can be heard yelling before shooting into Irizarry’s front driver’s seat.
It is also audible that one officer told Irizarry to reveal his hands prior to the rounds being fired. Dial pulled off six close-range shots.
In Eddie’s automobile, two knives were discovered by the authorities. Eddie Irizarry Sr., the victim’s relative, said that it was used for stripping wire during his work as a mechanic.
Dial was charged on September 8, 2023, with five further counts, including willful manslaughter and first-degree murder.
But on Tuesday, at a preliminary hearing, Judge Wendy Pew dismissed the case for lack of evidence.
“Disagreement” was expressed by the Philadelphia District Attorney’s Office with the judge’s judgment.
After the hearing, the office released a statement saying, “In keeping with our oath to seek justice, we will move to have all criminal charges, including Murder, reinstated against this defendant.”
Since then, the criminal complaint against Dial on all counts has been refiled by the office. A hearing on the application has been set for October 25 before the Court of Common Pleas.
