American singer and television personality Erika Jayne has prevailed in a $5 million fraud case brought by the former coworkers of her ex-husband Tom Girardi. Philip R. Sheldon and Robert P. Finn, two of Girardi’s former coworkers, allegedly filed a lawsuit against her for her role in her husband’s alleged fraud and embezzlement case.
According to Jayne’s attorney, Evan C. Borges, Los Angeles Judge Richard Fruin found no evidence of “any malfeasance” in the 2020 lawsuit.
The judge decided on August 29 that the plaintiffs had failed to show that the Real Housewives of Beverly Hills star had any “actual knowledge” of Girardi’s alleged misbehavior. This is according to court documents obtained by Page Six. On August 31, Erika sent a message on her Instagram page announcing her victory.

Jayne had been charged by the lawyers with “aiding and abetting” her 83-year-old ex-husband in his purported crime. They asserted that the reality star knew Girardi was using the money from their settlement to support her opulent lifestyle.
Erika Jayne testified throughout the trial that she did not handle any bills at Girardi & Keese and that all ledgers were handled by her husband and his coworkers. Judge Fruin used this testimony to support his judgment.

Judge Fruin ruled that the plaintiff’s claims that Erika Jayne had “real knowledge” of money theft were based on “inferences” based on “circumstantial evidence,” such as her luxurious lifestyle, rather than actual proof.
According to the court, Tom Girardi and the plaintiffs’ “lavish and expensive pastime financed by the spouses’ shared property is not proof of the ‘actual knowledge of any infringement of fiduciary obligation.

Erika won the case with Tom Girardi despite being accused of stealing money meant for the Lion Air Flight 610 victims in several lawsuits, including a class-action lawsuit by Edelson PC.
