The pair enjoyed a pleasant first year of motherhood throughout their two years of marriage.
In the fall of 2008, they were pregnant once more. However, the ex-husband and wife were also going through some difficult times in their marriage at the time.
Due to their inability to work through marital difficulties, Rutherford and Giersch eventually filed for divorce. In late December 2008, Rutherford filed for divorce, citing irreconcilable differences as the reason for their separation.
A provisional custody arrangement was made between the 51-year-old Gossip Girl star and German businessman Giersch about their children. But once Daniel’s visa was canceled in 2012 and he was deported from the country, the ex-pair had difficulties.
Their children were ordered to reside with their father in Monaco and attend school there by a Californian court in August of 2012. After the actress Rutherford’s children lived in France for three years, they were granted temporary exclusive custody in 2015.
In the meanwhile, a California judge decided in July 2015 that the court lacked the authority to grant their mother exclusive custody of the children since, at that point, she was a resident of New York. Kelly then filed a lawsuit in New York to get custody of the children, but the court declared that it lacked jurisdiction.
Conversely, in December 2015, a Monaco court granted their father exclusive custody of the children. The German businessman has had full custody of their children ever since.
