The lawyers argue that by denying the jurors this option, Chism’s right to due process was violated, and the jury was biased against him. They also say that this prohibited the jurors from considering Chism’s allegation of insanity.
The counsel in this case was required to get permission from the SJC before submitting their very lengthy brief.
In addition, since it took so long to get and review transcripts of the pretrial motions, trial, and sentence, Chism’s counsel postponed filing the formal appeal until 2021.
The SJC has given the Essex District Attorney’s office until the end of May to turn in its brief in this case. Once the brief was sent, the Chism team might attempt to respond to it.
