The devoted grandparents, who were beyond outraged by the tragedy, sued the city of Albuquerque in September 2017.
According to the lawsuit, their daughter, Michelle, was meeting men on online dating platforms without their knowledge in order to prostitute Victoria for money and her personal pleasure.

As part of a plea deal, she was given a sentence of 12 to 15 years. The shorter sentence was accepted despite the prosecution’s desire for 15 years due to her less significant involvement in the crime.
Michelle admitted to failing to safeguard her daughter even if she is not explicitly charged of doing so. In 2018, she admitted to killing a kid by abusing them carelessly.
She opted not to speak and showed no emotion while watching her sentencing hearing on November 10 from her cell through Zoom.
The third and last co-defendant in the girl’s killing is now in jail.
Michelle’s boyfriend Fabian Gonzales and Fabian’s cousin Jessica Kelley have received sentences for their participation in Victoria’s murder earlier this year. While Fabian was given a 37.5-year sentence in October 2022, Jessica is now serving a 44-year term.
It seems to put an end to one of the most horrible child abuse cases in Albuquerque. Prosecutors charged “John Doe” with first-degree murder in 2018 as a result of Jessica’s testimony and DNA evidence, but his name is still unknown.
Only four days before the murder, Jessica, who had only recently moved in after her release from jail, told police that Victoria was slain by a “well-dressed” Hispanic male who had broken into their apartment after Fabian had made threats during a barbeque.
