The Alameda District Attorney’s Office reports that a 41-year-old woman has been charged with threatening a mother and child at Strawberry Creek Park this summer and firing a gun into the air.
Tuesday saw the arrest of Tiffany Payne at her Bay Point home. She was charged with making criminal threats, as well as using a firearm improperly and carelessly, intentionally injuring a child, and using a weapon to commit a crime.
The incident happened on August 29 in the city’s Strawberry Creek Park area, according to Berkeley Police. A lady named Tiffany Payne is accused of approaching a 5-year-old kid and starting to annoy him in the 2200 block of Bonar Street.
Following witness interviews and analysis of local surveillance footage, investigators were able to identify the culprit. After executing a search warrant at her Bay Point House on November 29, detectives were able to apprehend the suspect. A loaded firearm that had been taken in an Oakland robbery was also discovered.

Payne acknowledged to the shooting on Berkeley’s Bonar Street, according to court documents. She was also wanted by the Hercules Police Department on suspicion of another firearm possession offense.
She was accused of using a firearm unlawfully. According to ARS 13-3107, firing a gun illegally is a Class 6 felony. The person must have used criminal negligence when firing a firearm inside a municipality’s borders.
She was then charged with making criminal threats, including reckless gun usage, child abuse, and committing a felony while in possession of a handgun.
The altercation took place in a driveway between two apartment buildings near Strawberry Creek, according to Berkeley Police. There were several children there when the incident took place, and the gunshots may have injured them.

Payne allegedly tried to provide suspected marijuana to a 5-year-old child on August 29 at 4 p.m. in a driveway between two apartment buildings next to Strawberry Creek Park on the 2200 block of Bonar Street.
The mother of the child approached Payne, who, according to the criminal complaint, pulled a pistol from his pocket and pointed it at the mother’s head from a short distance away.
The lawsuit claims that after saying, “The next one is for you,” Payne fired the gun into the air and threatened to shoot the mother.
