But lately, the issue surrounding his involvement in the well-known Toshakhana case involving former Prime Minister Imran Khan has cast doubt on his reputation.

Judge Humayun Dilawar was given the high-profile Toshakhana case by the Islamabad High Court in April 2023.

He sentenced Imran Khan to three years in prison and a punishment of Rs one lakh on August 5, 2023, for lying about gifts he accepted from foreign dignitaries while serving as prime minister.

The main focus of the Toshakhana case was the gifts that Khan had received but had neglected to declare to the electoral officials as required by law.

The estimated value of the gifts was Rs 140 million. Khan gave false justifications when questioned by authorities, which resulted in his removal from office as prime minister in 2022.

Posts purportedly from the Pakistani judge’s Facebook account began to circulate in early August, criticizing the military and administration.

According to the tweets, he was being pressured by Khan and his allies to rule in Khan’s favor in return for bribes. They claimed he was being threatened in order to keep Khan out of trouble.

According to Pakistani media, Ayesha Dilawar, the wife of Humayun Dilawar, released the posts.

As a result, the Federal Investigation Agency started looking into the situation after Khan’s attorneys filed a complaint against Dilawar. The controversy called into question his objectivity and honesty as a judge.

The highly contentious social media posts were leaked under Humayun’s identity. In them, he attempted to deceive the public about Khan and his prime ministerial handling while also openly criticizing authorities.

According to a post dated June 30, Khan’s followers were pressuring the judge to unjustly shield the former prime minister from prosecution. It claimed bribery offers and threats were being used to force him.

Subjective thoughts on Khan, his party, the PTI, and political matters were expressed in the posts. People are entitled to their own opinions, but when a judge openly expresses one, it undermines their objectivity.

The controversy sparked worries that Dilawar would have compromised his objectivity in violation of judicial ethics.

According to Pakistan’s legal law, judges must make decisions that are impartial and independent. The posters gave the impression that one side of the Toshakhana case was improperly aligned.

Pakistani political analyst and ambassador Zafar Hilaly has offered his thoughts on the judge’s widely shared Facebook remark.

On August 5, in spite of the uproar, he denied Khan’s request to have the case dismissed and gave the former prime minister a three-year prison sentence.

The FIA is still looking into the origin and veracity of the posted leaks. The judge’s credibility is damaged by the Dilawar message incident, even though he is still in charge of the closely followed Toshakhana case.
